  GENERAL TERMS AND CONDITIONS OF SALE

Making a purchase
Making a purchase of our products could not be easier, just browse our web site for the items required and press click. All your selections will be forwarded to the shopping trolly and once you have finished click on 'CHECK OUT', fill in a few details and your order will be ready to send to us.

We do not charge for any item until it is ready for despatch. Backordered items are not charged until they are despatched. You may send your credit card information via phone, fax, mail or over the Internet.

Shipping and handling
There are various delivery options available,
Please note that standard UK delivery is a 3 day service, with delivery days being Monday to Friday. Orders must be received before 4pm, after this time orders will be despatched on the following working day.

Back orders
If your item is not in stock, we will endeavour to back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.

This applies to items purchased from Euro-Cut Abrasives. Our 30 day "no quibbles" guarantee means that if for any reason you are unhappy with your purchase, you can return it to us in its original condition within 30 days of the date you received the item, unopened (with any seals and shrink-wrap intact) and we will issue a full refund. Please note: we can only accept the return of opened items if they are faulty. Please contact us immediately if you have a problem

DETAILED TERMS AND CONDITIONS OF SALE

  • Definitions.
    In these conditions "The Company" meaning Euro-Cut Abrasives; "goods" meaning any item of whatsoever nature which is to be sold by the company; "the customer" means the person firm or body corporate which buys or has agreed to buy the goods.

  • General.
    (a) These conditions shall apply to and form part of every contract of sale entered into by the company, and no variation or abrogation of these conditions shall be effective unless it is evidenced in writing and signed by a director of the company and such writing contains a specific reference to these conditions being varied or abrogated.
    (b) The placing of an order for goods, whether or not based upon a quotation given by the company shall not constitute a contract of sale between any person, firm or body corporate and the company, unless and until it has been accepted by the company in writing.
    (c) In the case of any conflict between these conditions and those contained in any order, acceptance, or other document or communication submitted by the customer, these conditions shall prevail.


  • Prices And Minimum Orders.
    (a) All prices quoted by the company are exclusive of value added tax, which will be charged at the applicable rate and recoverable as part of the purchase price by the company.
    (b) Prices and discounts quoted by the company or appearing in the literature of the company are based upon prices ruling at the date when they are quoted or given, and are subject to alteration without notice. The company shall be entitled to charge and the customer agrees to pay, the price or prices ruling at the date of despatch of the goods.

  • Payment.
    Unless otherwise agreed in writing payment shall be made before despatch of goods. In the event of payment by cheque or draft, payment shall be deemed not to have been made until the cheque or draft has been cleared and the proceeds have been collected by the bankers of the company.


  • Risk And Passing Of Property.
    (a) The Risk in the goods shall pass to the customer immediately on delivery of the goods to the customer.
    (b) The ownership of the goods shall remain with the company which reserves the right to dispose of the goods until the price of the goods together with all other sums which are owed by the customer to the company have been paid in full.
    (c) Until such payment as aforesaid has been made in full the customer shall hold the goods as a fiduciary and bailee of the company, and the customer shall be under an obligation to redeliver the goods to the company if the company so requires and the company shall be entitled at any time to retake posession of the goods and for that purpose to enter upon any land or premises of the customer where the goods may be for the time being and the company shall be entitled, where the goods have been fixed to or attached to any other product, to detach the goods in order to recover posession of them.
    (d) Until such payment as aforesaid has been made in full, the following shall apply: The customer shall store the goods in such a way that, they can be clearly recognized as the property of the company, and shall properly protect and insure the goods. The customer shall have the right to use the goods or to sell the goods in the ordinary course of its business, provided that in cases where it sells the goods the customer shall sell as fiduciary agent of the company, and provided that the customer shall have no right to commit the company to any contractual relationship with or liability to any other person. The customer shall hold all proceeds whether tangible or intangible of any such sale of the goods by the customer as aforesaid in trust for the company and shall account to the company for such proceeds.
    (e) The Company shall have the power to appropriate payments made by the customer to the company to such goods and accounts as it thinks fit, notwithstanding any purported appropriation by the customer to the contrary.
    (f) The company shall have the right to maintain an action for the price of the goods whether or not the property in the goods has passed. Nothing in this condition shall confer upon the customer the right to return the goods or to refuse or delay payment for them.


  • Delivery.
    Any damage to the goods, or short delivery of the goods, shall be notified to the company within 21 days of delivery. The company shall not be liable for any damage to or short delivery of goods where the carriers have been given a clear receipt.


  • Time For Delivery.
    (a)All times or dates for delivery of goods are approximate only. Time for delivery of goods is not of the essence of the contract.
    (b) Unless otherwise stated in writing the company shall be entitled to make partial deliveries of the goods, and these conditions shall apply to each partial delivery.
    (c) The company shall not be liable in any way for consequences of any delay in delivery or performance of any of its obligations.
    (d) In particular but without prejudice to the generality of the foregoing, the company shall not be under any liability whatsoever for any delay caused directly or indirectly by any circumstances beyond its reasonable control, including but not limited to acts of god, war or other hostilities, riot or civil disturbance, government action or legislation, transport delays, machine failure of any kind, shortages or delays in obtaining labour disputes (whether or not involving employees of the company). The company shall be entitled in any of the events mentioned to cancel or suspend the contract at any time so far as it is unfulfilled without prejudice to any of its rights in respect of any part of the contract already performed. At the request of the customer, the company shall state whether or not it will cancel the contract or will deliver within a reasonable period of time to be determined by the company.

  • Warranty.
    (a) The company will at its own option either repair or replace free of charge any goods which under proper use prove to be defective due to faulty materials or bad workmanship within a period of twelve months after the delivery of the goods. Provided that the customer shall have notified the company of the defect within 21 days of discovery of the defect, and provided that the customer shall have returned the defective goods to the company as soon as reasonably practicable thereafter and in any event within 14 days after notification of the defect.
    (b) The company shall have no liability in respect of fair wear and tear, or in respect of defects, damage, deterioration or failure to perform or poor performance due to negligent or incorrect handling or storage or maintenance or use of the goods by the customer or the customers employees or agents, or in respect of any case in which damage or deterioration is due to any cause beyond the reasonable control of the company.
    (c) The company shall not under any circumstances be liable for any loss of business or loss of contracts or loss of profits or loss of production arising from any defective goods, whether by way of breach of contract, or tort, or breach of statutory duty or any other cause whatsoever.
    (d) Nothing in this condition shall affect the statutory rights of a person dealing as consumer, nor does it purport to exclude any liability in respect of death or personal injury caused by any negligence or any other liability which may not be excluded by virtue of any statute.
    (e) Except as herein provided, the liability of the company under this condition shall be in lieu of any condition or warranty or other term expressed or implied by law as to the quality or fitness for any particular purpose of the goods.


  • Specifications.
    (a) Dimensions and other specifications given in the literature of the company are given as at the date of publication thereof and are as accurate as is reasonably practicable, but no condition or warranty is given that they are completely accurate or exact.
    (b) The Company reserves the right to make alterations to specifications without notice in the interests of improved performance, health or safety. Law Applicable. All contracts to which these conditions apply shall be governed by and construed in accordance with English law
